3 Information on the contractual relationship

​

The contractual relationship is based on our freelance agreement (Freelance Coach Agreement), which defines how we work together. All your rights as a freelance fitness trainer are locked in and spelled out right there.

3.1 Please provide details of the activity to be assessed.

​

"Activity to be assessed" means that the DRV wants to know what activity you are performing for BEAT81 and when you started it

​

Exact title = you work as a "Self-employed Fitness Trainer"

​

Start of activity = The first class you teach after you pass the Premiere.

​

End of employment = no end, as you’ve got an open-ended framework deal on your hands.(exception: the agreement was terminated. If this is the case, please fill in the date of your last class)

​

Is it a recurring contractual relationship based on your framework agreement?

​

You have closed a framework agreement with BEAT81, which gives you the opportunity to conduct your classes according to your availability. As a freelance coach, you can decide for yourself whether you offer training sessions at all and, if so, how often. BEAT81 does not specify a minimum or maximum number of training sessions. The term "recurring contract relationships" refers to the individual classes. However, these are not guaranteed, but you are free to decide whether and how many classes you take on.

3.2 Are there any contractual obligations that require the employment status to be determined?

The answer to this question must be "yes" and the framework agreement must be sent to the DRV.

4 Information on family relationships

​

4.1 Are the contractor and the client married, related by blood or marriage, or is there a registered civil partnership or other family relationship (please enclose a copy of proof)?

​

BEAT81 is your client and the DRV would like to know whether there are any family or kinship relationships between BEAT81 and you.

Further documents must be submitted in the event of a positive answer. In general, the answer to this question should be "no".

5 Activity within a GmbH or KG

​

5.1 Is an activity exercised as a shareholder-managing director, external managing director or working partner of a GmbH and / or limited partner of a KG?

​

This is not about whether you work for another company as a shareholder-managing director, external managing director or working partner of a GmbH and / or limited partner of a KG, but about whether you take on one of these roles vis-à-vis BEAT81. In general, this is not the case, so you must complete the additional questionnaire C0031.

Terms:

GmbH = a form of corporation in Germany. It can be founded by one or more shareholders.

KG = an association of at least two partners who operate a commercial business under a joint company name.

6 Information on the participation of third parties (triangular relationship)

​

This is referred to as a triangular relationship if other parties are involved in the contractual relationship between BEAT81 and you. These other parties are not the participants of the classes, but external companies that can, for example, commission BEAT81 as a provider of fitness classes and pay BEAT81 for this service. However, this is not the case, so the question must be answered with "no".

6.1 Is the activity to be assessed carried out in a triangular relationship for or with a third party?

​

Please take into account the information under point 6. The contractual relationship exists exclusively between BEAT81 as the client and you as the contractor. No third person or company is involved.

7 Information on further procedures

7.1 Has an assessment procedure already been initiated by a health insurance fund or a pension insurance institution for this activity or has a determination been made that self-employment exists or that a dependent employment relationship exists?

Have you already carried out a status assessment procedure with the DRV for your activity as a freelance coach?

8 Expert opinion on employment status in the same employment relationship

You submit the application together with BEAT81. In our contractual relationship, you are the contractor. Please select the answer accordingly.

10 Information on the contractor's health insurance relationship

In Germany, everyone is legally obliged to be insured with a health insurance fund. The DRV therefore assumes that you are insured. There are statutory and private health insurance funds.

10.1 Are you or were you insured with a statutory health insurance fund?

11 Information on shareholdings and memberships in companies

​

This question is addressed to you as a self-employed fitness trainer.

It is about whether you have founded a company for this activity, for example, or have a share in a company (which is not BEAT81).

11.1 Have you set up a company to carry out your activity or do you have a shareholding in a company?

​

Company = a setup for making business moves.

​

If you have ticked yes, please attach a copy of your articles of association.

​

11.2 Are you a member of the management board of a stock corporation?

​

Management board of a public limited company = leading group of people who manage a company. A stock corporation is a type of company in which the share capital is divided into shares.

Please indicate whether you are a member of the management board of such a stock corporation (AG).

13 Document access

The DRV wants to make sure that you receive all DRV letters and offers you different ways to receive DRV mail. Please choose the best option for you.

13.1 You can correspond with the DRV by DE e-mail only. If you choose this answer, you will not receive any DRV letters by post.

IMPORTANT: Always keep all DRV letters! Make copies of all documents and letters sent to the DRV in the course of the procedure.

14 Contractor's declaration

14.1 I hereby apply for the contractual relationship to be assessed to determine that:

As a freelance coach for BEAT81, you submit this application so that your activity is recognized as self-employment by the DRV. The basis for this is our framework agreement.

​

14.2 If self-employment is established: The monthly income from this activity regularly exceeds the marginal earnings threshold (538 EUR from 1.1.2024).

​

Low income threshold = the amount you can have as income without paying social security contributions. This is currently 538 EUR per month.

With this question, the DRV would like to know whether you regularly earn more or less than EUR 538 per month through your work as a freelance coach for BEAT81. Please check the appropriate box.

14.3 I intend to apply for an expert opinion if it is determined that the contractual relationship to be assessed is a self-employed activity.

Expert opinion = group determination of the employment status of contractors working in the same contractual relationship

The DRV asks whether an expert opinion should be issued if it is confirmed that you are considered a freelance coach for BEAT81.

You are welcome to answer "yes" to this question, but it largely concerns BEAT81 rather than you.

I confirm that the information I have provided is true and that the agreements in the documents/contracts sent correspond to the actual circumstances or intended circumstances of contract implementation. *If a decision on the employment status is made before the commencement of the activity in accordance with § 7a paragraph 4a sentence 1 SGB IV, I will immediately notify any changes to the written agreements or the circumstances of the contract implementation up to one month after the commencement of the activity.
